Welcome to ClinikPe. These Terms & Conditions (“Terms”) govern your access to and use of the ClinikPe website, mobile applications, and related services (collectively, the “Platform”).

By accessing or using ClinikPe, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About ClinikPe

ClinikPe is a healthcare technology platform that provides tools for:

• Doctors to create digital prescriptions and manage appointments
• Clinics and diagnostic centers to manage centers, providers, schedules, bookings, billing, and reports
• Patients to book appointments and access shared medical records

ClinikPe does not provide medical advice and does not interfere in clinical decisions.

2. Eligibility

You may use ClinikPe only if:

• You are at least 18 years of age
• You are legally capable of entering into a binding agreement
• For doctors: You are a qualified medical professional registered under applicable laws
• For clinics/labs: You are a legally operating healthcare establishment

3. Account Registration & Access

• Login is provided via OTP-based authentication using mobile number or email
• You are responsible for maintaining the confidentiality of your account
• You must provide accurate and up-to-date information
• ClinikPe reserves the right to suspend or terminate accounts with false or misleading information

4. Use of Services

Doctors

Doctors may:

• Create and share digital prescriptions
• Manage appointment schedules
• Share booking links and QR codes
• Access patient records shared with consent

Doctors are solely responsible for:

• Medical advice
• Diagnosis
• Prescriptions
• Compliance with medical laws and ethics

Clinics & Diagnostic Centers

Clinics and labs may:

• Create organizations and centers
• Add providers and staff users
• Manage bookings, schedules, lab tests, and reports
• Generate invoices and receipts

Clinics are responsible for:

• Accuracy of center details
• Provider credentials
• Compliance with healthcare, GST, and local regulations

Patients

Patients may:

• Book appointments
• Share medical records with doctors or clinics
• Access prescriptions and reports shared with them

Patients control who can access their medical records.

5. Medical Records & Data Sharing

• Medical records are securely stored and encrypted
• Records are shared only with explicit user consent
• ClinikPe does not access or use medical data for diagnosis
• Users may revoke access at any time

6. Payments, Fees & Invoicing

• Some services may be free, paid, or offered under trial plans
• Clinics and doctors may charge patients directly
• Online payments, when enabled, may involve third-party payment gateways
• ClinikPe is not responsible for disputes between patients and providers

Invoices and receipts are generated based on information provided by clinics or labs.

7. Free Trial & Subscription

• ClinikPe may offer free trials for certain features
• Trial duration, features, and limits may change
• After trial expiry, paid plans may apply
• ClinikPe reserves the right to modify pricing with prior notice

8. Prohibited Activities

You agree not to:

• Use the platform for illegal or fraudulent purposes
• Upload false medical credentials
• Misuse patient data
• Attempt unauthorized access
• Copy, reverse engineer, or exploit the platform

9. Intellectual Property

All content, software, designs, logos, and trademarks on ClinikPe are the property of ClinikPe or its licensors.

You may not use them without prior written permission.

10. Account Suspension & Termination

ClinikPe may suspend or terminate your account if:

• You violate these Terms
• You misuse the platform
• Required verification fails
• Required by law or regulatory authorities

Users may request account deletion at any time.

11. Limitation of Liability

ClinikPe is a technology platform only.

We are not liable for:

• Medical outcomes
• Treatment decisions
• Missed appointments
• Disputes between patients and providers
• Data shared with consent by users

Use of the platform is at your own risk.

12. Indemnity

You agree to indemnify and hold ClinikPe harmless from any claims, losses, or liabilities arising from your use of the platform or violation of these Terms.

13. Changes to Terms

ClinikPe may update these Terms from time to time.
Updated terms will be posted on the website with the revised effective date.

Continued use of the platform constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of India.
Any disputes shall be subject to the jurisdiction of courts in Howrah, West Bengal, India.
